1. Acceptance of Terms
By accessing and using sibiinnovations.com, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, users, and clients.
2. Services
Sibi Innovations provides web design, web development, mobile app development, ecommerce solutions, SEO, and digital marketing services. Specific service deliverables, timelines, and pricing are defined in individual project agreements or proposals issued to clients.
3. Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, required content and assets, and necessary approvals. Delays caused by late client input may affect project timelines. Clients must ensure they have the legal right to use any content, trademarks, or images provided to us.
4. Payment Terms
Standard payment structure is 50% advance before project commencement and 50% balance before final delivery or go-live. Custom payment schedules may be agreed upon for large projects. All payments are in Indian Rupees (INR). Late payments may result in work being paused until settlement.
5. Intellectual Property
Upon receipt of final payment, clients receive full ownership of all custom-developed code, designs, and content created specifically for their project. Sibi Innovations retains the right to display completed work in our portfolio unless otherwise agreed in writing. Third-party components (plugins, stock images, licensed fonts) remain subject to their respective licences.
6. Confidentiality
Both parties agree to keep confidential any proprietary information, business data, or trade secrets shared during the project. This obligation continues for 2 years after project completion. We will not share client business information with competitors or unrelated third parties.
7. Warranties and Disclaimers
We warrant that our work will be performed with professional skill and care. However, we do not guarantee specific search engine rankings, specific conversion rates, or specific business results from our services, as these depend on many factors beyond our control including market conditions and third-party platform changes.
8. Limitation of Liability
Sibi Innovations' total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific project in question. We shall not be liable for indirect, consequential, or incidental damages including loss of profit or business opportunity.
9. Project Cancellation
If a client cancels a project after work has commenced, any advance payment is non-refundable for work already completed. If Sibi Innovations cancels a project without cause, we will refund any advance payment for work not yet performed. Notice of cancellation must be provided in writing.
10. Website Usage
You may use our website for lawful purposes only. You must not attempt to gain unauthorized access to our systems, post harmful content, or use our website in a way that infringes the rights of others. We reserve the right to restrict access to users who violate these terms.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the jurisdiction of the courts of Karur, Tamil Nadu, India.
12. Changes to Terms
We reserve the right to modify these terms at any time. Updated terms will be posted on this page with a revised date. Continued use of our services after changes constitutes acceptance of the revised terms.
